Overview

These Terms of Service (“Terms”) govern your use of the ZUMA Market website and purchases made through it.

The website is operated by ZUMA Market LLC, a Wyoming limited liability company operating as ZUMA Market. References to “ZUMA Market,” “we,” “us” and “our” mean ZUMA Market LLC. Our website, content, features, tools and shopping services are collectively referred to as the “Services.”

Our store is powered by Shopify.

By using the Services or placing an order, you agree to these Terms. Our Privacy Policy explains how personal information is handled.

Nothing in these Terms limits rights or remedies that cannot lawfully be excluded or restricted.

1. Access and Accounts

You must be at least the age of majority in your place of residence to place an order.

You agree to provide accurate, complete and current contact, billing, payment and shipping information. You must be authorized to use the payment method provided.

If you create an account, you are responsible for safeguarding access to it and promptly notifying us of suspected unauthorized use. You may not sell or transfer your account to another person.

2. Products and Product Information

ZUMA Market offers products from selected partner brands. Products may be shipped directly by those brands or their fulfillment providers.

We aim to present product descriptions, materials, specifications, availability and images accurately. Colors and appearance may vary according to your screen settings, lighting and normal manufacturing variations. These variations do not excuse a product that is defective, incorrect or materially different from its description.

Descriptions and availability may change for future purchases. The product conditions and policies displayed when you placed your order apply to that purchase.

Follow the manufacturer’s instructions, warnings, age recommendations and care requirements. Contact us before ordering if you need clarification about a product or its suitability for a particular use.

Our selection of a product does not guarantee that it will be suitable for every person, sensitivity or circumstance.

3. Orders and Acceptance

When you place an order, you authorize us and our payment providers to process payment for the amount shown at checkout.

Our order confirmation email confirms acceptance of your order, subject to our rights under these Terms and applicable law to address errors, unavailable products, payment issues or suspected fraud.

We may decline or cancel an order for a legitimate reason, including unavailable inventory, an unresolved payment issue, a material pricing error or suspected unauthorized activity. We will notify you if an order is declined or canceled. If payment has been collected for canceled items, we will refund the corresponding amount, including applicable taxes and shipping charges attributable to those items.

We will not substitute a different product or increase the agreed price without your consent.

Purchases through the consumer storefront are intended for personal or household use. Contact us separately about business or resale purchases.

4. Prices, Payments and Promotions

Prices are displayed in US dollars unless expressly stated otherwise.

Applicable taxes and shipping charges are shown at checkout before you submit your order. The total confirmed at checkout is the amount you authorize.

Prices and promotions may change for future purchases. A later price change does not change the price of an accepted order.

Promotions may have additional eligibility requirements, exclusions and expiration dates. Those terms apply to the relevant promotion.

You agree to provide accurate payment information and authorize the charges associated with your purchase.

5. Shipping and Delivery

We currently accept orders for delivery to eligible United States addresses. Availability, address restrictions and shipping services may vary by product and partner brand.

Products may ship directly from different partner brands or fulfillment locations. Orders containing products from more than one brand may arrive in separate shipments, with different tracking details and delivery dates.

Shipping charges and available services are displayed at checkout. Review product pages and our Shipping Policy for applicable processing times, delivery estimates and product-specific arrangements.

Delivery estimates are not guarantees unless expressly identified as such. If we cannot ship within the promised timeframe, we will notify you, explain the revised timing and provide the cancellation and refund options required by applicable law. Where consent to a delay is required, we will obtain it or cancel and refund the affected items.

If an order arrives damaged, incomplete or incorrect, or tracking shows delivery but you cannot locate it, contact ZUMA Market promptly. We will coordinate an investigation and an appropriate resolution with the brand and carrier.

For freight deliveries, inspect the shipment before signing where possible and record visible damage or missing cartons on the delivery receipt. These steps help us resolve claims and do not remove rights available under applicable law.

6. Cancellations, Returns, Refunds and Exchanges

Our Returns & Refunds Policy forms part of these Terms.

Return eligibility, deadlines and conditions vary by product. Some products are final sale for change-of-mind returns. Selected Naturepedic mattresses expressly identified on their product pages qualify for the 30-Day ZUMA Trial.

Contact ZUMA Market before sending back any product. Wait for authorization, the correct return address and shipping or handling instructions. Products from different brands may require separate packages or return labels.

Customers are responsible for applicable change-of-mind return costs as described in our policy. Any label, collection or authorized disposal costs arranged by us will be disclosed before you agree to them. Providing a label does not automatically mean that a return is free.

Contact us immediately if you need to change or cancel an order. Cancellation is confirmed only once accepted by the fulfilling brand. Orders may ship before tracking becomes available. This does not restrict cancellation or refund rights available under applicable law, including rights relating to delayed shipment.

Refusing delivery does not automatically cancel an order or authorize a return. Please contact us before refusing a shipment.

Final sale restrictions do not prevent you from reporting damaged, defective, incorrect or materially misdescribed products.

7. Research, Educational Content and Product Guidance

Our research, articles, product comparisons and customer guidance provide general information to help you make informed decisions.

They do not constitute medical advice, diagnosis or treatment and do not replace advice from a qualified healthcare professional. Do not disregard or delay professional advice because of information on our website or communications with us.

Unless expressly stated and appropriately supported, we do not represent that a product prevents, treats or cures a disease or guarantees a particular health outcome.

Research and product information may develop over time. We aim to distinguish supported findings from limitations and uncertainty and to correct material inaccuracies when identified.

8. Intellectual Property

Content on the Services, including original text, research, graphics, images, designs and logos, belongs to ZUMA Market or the respective rights holders and is protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial purposes. Any copying, republication, distribution or commercial use requires permission from the relevant rights holder unless permitted by law.

Partner brand names, product images, descriptions and trademarks remain the property of their respective owners. Purchasing a product does not transfer intellectual property rights.

Nothing in these Terms restricts lawful quotation, fair use or other rights available under applicable law.

9. Third-Party Tools and Links

The Services may include third-party tools, integrations or links. Their separate terms and privacy policies may apply.

We do not control independent third-party websites and are not responsible for their content or transactions made directly through them, except where applicable law provides otherwise.

For products purchased from ZUMA Market, contact us for order support even when a partner brand fulfills the shipment.

10. Relationship with Shopify

ZUMA Market is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver the Services.

Purchases made through our store are transactions with ZUMA Market. Shopify is not the seller of the products and does not fulfill ZUMA Market’s obligations to you as the retailer.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims arising solely from the sale of products by ZUMA Market. Nothing in these Terms excludes responsibilities or liability that cannot lawfully be excluded.

11. Privacy

Our Privacy Policy explains how we collect, use and disclose personal information, including through Shopify, our partner brands and service providers.

Shopify also processes information about interactions with our store, including to provide its Enhanced Services. Further information is available in the Shopify Consumer Privacy Policy and through the Shopify Privacy Portal.

12. Reviews and Feedback

You retain ownership of reviews and other content you submit.

When you submit content for public display, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display and format it as reasonably necessary to operate and promote the Services. We will not materially change its meaning.

Reviews must reflect your honest experience. Disclose any compensation, free product or other material incentive connected with a review.

We may remove content that is fraudulent, unlawful, unrelated to the product or service, infringes another person’s rights, exposes private information or contains threats or abusive material. We do not remove reviews merely because they are negative.

Nothing in these Terms prohibits honest reviews or lawful complaints.

Private customer support messages are handled under our Privacy Policy. Sending us a support message does not grant permission to publish it as a testimonial.

13. Errors and Corrections

We may correct inaccuracies relating to descriptions, prices, promotions, shipping information or availability.

If a material error affects an order you have placed, we will contact you to explain the issue and any available options. We will not charge an increased amount or materially change your order without your consent.

If the affected order or item is canceled, we will refund the relevant payment.

14. Acceptable Use and Automated Access

You may not use the Services to:

• Commit fraud, impersonate another person or provide deliberately misleading information.

• Violate applicable law or another person’s intellectual property or privacy rights.

• Harass, threaten or abuse others.

• Introduce malware or interfere with the security or operation of the Services.

• Collect personal information about others without authorization.

• Send spam or unauthorized commercial communications.

• Bypass access restrictions, security controls or measures intended to prevent abuse.

• Extract or commercially exploit website content in violation of applicable law or the rights of its owners.

Automated tools must respect applicable access restrictions and must not conceal their identity to bypass security measures, overload the Services or make unauthorized transactions.

These restrictions do not prohibit honest criticism, lawful reviews or ordinary use of accessibility tools.

15. Suspension and Termination

We may restrict or suspend access where reasonably necessary to address a breach of these Terms, fraud, security threats or unlawful activity.

Suspending an account does not remove our obligations concerning accepted orders, refunds or rights available under applicable law.

Provisions that by their nature should continue after termination will remain in effect.

16. Warranties

Manufacturer warranties, where available, are separate from our change-of-mind return conditions. Contact us for help navigating the applicable warranty.

We do not provide an additional commercial warranty unless expressly stated.

To the extent permitted by applicable law, we do not guarantee that website access will always be uninterrupted or error-free.

Nothing in these Terms excludes applicable statutory or implied warranties, remedies for defective or misdescribed goods, or express commitments made in our product descriptions and policies.

17. Limitation of Liability

To the extent permitted by applicable law, ZUMA Market is not liable for indirect or consequential losses arising from use of the Services, such as lost business profits or business opportunities.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, product liability or any other matter to the extent that liability cannot lawfully be excluded or limited.

This section does not restrict your entitlement to refunds, replacements or other remedies available under applicable law or our published policies.

18. Responsibility for Misuse

To the extent permitted by applicable law, you are responsible for third-party claims and reasonable losses directly caused by your unlawful use of the Services, infringement of another person’s rights or intentional material breach of these Terms.

This does not require you to cover losses caused by our own conduct, ordinary authorized use of the Services, honest reviews or the exercise of consumer rights.

19. Events Outside Our Reasonable Control

Events such as severe weather, natural disasters, carrier disruptions or utility outages may affect performance.

Where an event affects your order, we will communicate relevant information and take reasonable steps to address the situation. Such events do not remove applicable obligations to provide delay notices, obtain consent where required or issue refunds.

20. Severability

If a provision is found unenforceable, it will be limited or removed to the extent necessary. The remaining provisions will continue to apply.

Mandatory consumer protections take precedence over conflicting provisions.

21. Entire Agreement and Waiver

These Terms and the policies they incorporate govern your use of the Services and purchases from ZUMA Market.

Our failure to enforce a provision on one occasion does not waive our ability to enforce it later.

Nothing in this section excludes express product commitments or rights and remedies available under applicable law.

22. Assignment

You may not transfer your rights or obligations under these Terms without our consent, except where permitted by law.

We may transfer these Terms in connection with a legitimate business transfer or restructuring, provided that the transfer does not reduce your existing rights or protections.

23. Governing Law

These Terms are governed by the laws of the State of Wyoming and applicable United States federal law, without overriding mandatory consumer protections that apply to you.

Subject to applicable law, disputes may be brought before courts with jurisdiction in Wyoming. Nothing in this section removes a right to bring a claim in another court where applicable law provides that right.

24. Translations and Headings

Headings are provided for convenience and do not change the meaning of these Terms.

If we provide a translation, the English version governs to the extent permitted by applicable law. This does not override mandatory language or consumer protection requirements.

25. Electronic Communications

We may communicate electronically about orders, deliveries, returns, accounts and other service matters. Please keep your contact information current.

Marketing communications are separate and are subject to your preferences and applicable law. Placing an order does not by itself require you to subscribe to marketing emails.

26. Changes to These Terms

We may update these Terms to reflect changes to the Services, business practices or legal requirements.

We will publish the revised version with an updated date and provide additional notice where required by law.

The Terms, product conditions and policies in effect when you placed an order apply to that purchase. Later changes will not retroactively reduce your rights relating to an existing order.
